Jan Malan Sues Arise Magazine & Nduka Obaigbena for $300,000 Unpaid Fees


Jan Malan, a South African, is one of the premiere fashion producers in Africa. Nduka Obaigbena is owner of ThisDay Newspapers and Arise Magazine, which fall under the parent company, Leaders and Company Limited

Statement by Jan Malan of Umzingeli Productions

Nduka Obaigbena - ultimate owner of Arise Magazine keeps himself afloat in the international fashion world by abusing small players through broken promises and dishonored financial commitments.

On 13 February 2010, Jan Malan of Umzingeli Productions successfully staged the Arise Magazine African Fashion Collective Part III show in New York.

New York Fashion Week’s Daily Front Row Magazine reported on Monday 15 February 2010:
“It was a rousing fashion moment at style mag Arise’s show, where Black Coffee, Loin Cloth & Ashes, and Deola Sagoe presented powerful Africa-themed collections. Each designer’s riveting, vivid talent shone through in Jan Malan’s flawless production.”

Nduka Obaigbena was praised in the New York Times for repairing the image of Nigeria and Africa.
Thereafter on 5 March, 2010, Jan Malan organized a press presentation, Arise Magazine L’Afrique-ă-porter where several African designers were introduced to the media listed with the The French Fashion Federation, all organized by Jan Malan for Arise Magazine.

After a string of broken promises of payment as well as some false proof of payments, Umzingeli Productions is still out of pocket to the tune of over US$ 300 000 for services rendered and cost incurred in paying for crew salaries, printing of invitations, programs, deposits for accommodation, flights, wardrobe and audio-visual.

The failure to effect payment has significantly affected Umzingeli Productions and Jan Malan personally who have had to fund a variety of costs which were incurred following a contractual commitment by Nduka Obaigbena’s company Leaders and Company Limited and various personal assurances by Mr Obaigbena that payment would be made.

Leaders and Company recently elected to pay some of Umzingeli Productions’s sub-contractors, such as Model Agencies in New York, directly, as to continue doing business in New York.

Arise Magazine is scheduled to stage another show at New York Fashion Week on 15 September 2011.
Umzingeli Productions has issued summons against Leaders and Company Limited.

Mr Obaigbena Sir, please note that personal integrity is as important as executive skill in business dealings....Setting an example from the top has a ripple effect, as it reflects on your business as a whole.Let your word be your bond. Litigation harms your brand, and destroys your integrity as a businessman.

to d left, to d left with dis nduka sef. he has a rep of treating africans like shit (models keep complaining of him owing dem fees and all) yet this same man paid beyonce a reported $1million only to peep inside her breast on her arrival!! mumu ni!!

Nduka is an eternal debtor.
Why he does not cut his coat according to his size baffles me.
almost a decade ago he launched THISDAY in SA and was owing journalists up and down.
After luring them from their previous employers with higher slararies, salaries were being paid late and often not at all.
It might be a normal case in Naija but in SA it is an abnormality.
The venture barely lasted a year.

I am so sad that your government allows this man to do whatever he likes,however, in a normal society he can not do this. I n south Africa he owed vendors and did not pay salaries and i hear in Dubai he owes printers millions from from thisday style.Typical of Nigeroan men and it is not good for your already ruined image.As for jan he is as racist as they come for me it is good for this self claimed best this and best that.This man just made his name from black people and he does not like black people believe me. He treated andi so badly and his first coloured booker was treated like shit and he brought this nasty ass english girl who finally ruined O models.Good for jam

Jan Malan doesn't like blacks unless he's making money from them. Good that Nduka will teach him a lesson. He should be banned from working in any African country. We Nigerians we love to give jobs to foreign people who don't even respect us. Look at the way Airtel dumped all its staff. I hear The First Group pays its white staff a higher wage and Nigerians a lower wage. Its our fault for letting them in...
